How long does the process take?
This ranges from case to case. Generally however, you should receive your settlement cheque between 2 and 6 months if you wish to settle quickly.

Do I have to pay any fees?
Absolutely not! Your case will be set up on a conditional fee agreement (CFA) this means ‘no win no fee’ so if your case is unsuccessful there will be no fee. If you are successful (which 99% of our cases are) all fees will be paid for by the insurance company that is responsible for the accident. So in any event you will have nothing to pay and you will keep 100% of your compensation.

How much compensation will I secure?
This ranges depending on the type of injury. Most cases settle between £1000 and £5000. The compensation is loosely based on the period of suffering. So a one month whiplash injury may be valued at £1000, symptoms lasting 12 months would be valued up to £2750 and symptoms lasting longer than that would be valued up to £4750. So it is very important that you take into account all symptoms before you confirm how long your injury has lasted.

Will I receive 100% of my compensation?
Always! All fees are payable by the insurance company that your claim is against. This means that you always get 100% of your compensation and will not have to pay a penny…win or lose.

What is the process?
Here at Complete Claim Solutions we have a Unique 3 Step Claim…
1. The first is the stage you are at now, you need to simply complete and return the paperwork to us.
2. The second is proving your injury. In some cases the insurer accepts our word for the injury sustained. In most cases especially when the symptoms are ongoing it is advised that you attend a GP appointment which we arrange on your behalf. If you have fully recovered at the time of the appointment then you simply need to explain the symptoms that you experienced at the time and how long they have lasted. The consultation usually takes 5 – 10 minutes. If your symptoms are ongoing the GP will predict how long the remaining symptoms will last for i.e. 6 months from the examination etc. The medical report will then be forwarded to the insurance company for an offer.
3. The third stage is considering the offer made by the insurers. When an offer is made we can advise if the offer is reasonable. In most cases the offer can be negotiated to a reasonable amount and is there for you to accept. Once accepted the settlement cheque will follow in a matter of a couple of weeks.

What happens if the insurance company approaches me directly to make an offer?
Occasionally insurance companies will approach you directly to make you an offer to settle early. If this does happen under no circumstances should you discuss the claim with them directly. Their main aim is to save themselves money. Any offer that they are looking to make to you can be made to your legal representatives and can settle just as quickly if you so wish. In all cases you should refuse to discuss your claim with them and inform them in no uncertain terms that you have legal representation. If you engage with the insurers directly this can be the only scenario in which you may be liable for the legal costs as the solicitor will not be in a position to fully recover them.

How long do I have from my accident date to make a claim for Personal Injury?
You have three years from the date of your injury to make a claim. If the accident involved a minor (under 18), the three years does not start until the minor’s 18th birthday. Do I have a genuine claim?
If you have been injured through no fault of your own, then most probably. Each claim can be assessed quickly and easily over the phone by one of our experienced handlers, so please do give us a call to discuss your specific circumstances. If a case is accepted by us verbally over the telephone, we are 99% confident that you will succeed in gaining compensation. Did I need to attend my GP to report inuries at the time of the accident?
No. If you did attend your GP it may help slightly, however this is not vital and we can still proceed with your case if you did not attend hospital or a doctors surgery.

Will I have to attend a medical?
In most cases you will need to visit an independant doctor for a medical examination and so that the injuries can be documented. This process can take only five minutes for a simple whiplash case, however if you require rehabilitation or further advice then of course the expert will give you all the time you need. You can include the travel expenses to the medical as part of your claim.

What if I am fully recovered by the time of my medical?
Then you simply explain the symptoms you had after the accident, and how long you suffered for, to the doctor. These are then recorded on file.

Will I have to go to court?
The choice is yours. 99% of our cases settle out of court for the simple reason that we have excellent negotiators working on your case at settlement stage so it is rare that we cannot obtain an offer that is more than reasonable. If the final offer is under what we would expect you to achieve in court, then we will advise you of this and it will your decision if you chose to accept the offer or proceed down the court route.
