All the fees are paid for by the “at fault” insurer. Most cases are set up on a “no win – no fee” agreement, also known as a CFA or Conditional Fee Agreement. This means that the fee is conditional to a successful claim. So if you win, the insurance company pays the fee. If you lose the fee is waived.
It is a legal requirement that you see how all the costs are calculated, so please don’t be alarmed when you receive paperwork for your records that explain the fees on an hourly rate basis. This is does not mean that you will pay these costs and we have to forward it to you for legal reasons. Legally we can’t charge the insurance company for our costs if you are not aware of them. As we have said, you will not have to pay for any costs whatever the outcome of your case.
No Win No Fee – CFA Explained.
In most legal matters when you instruct a solicitor you will have to pay for their fees. In personal injury cases this is different. The “conditional fee agreement”, “CFA” or “no win no fee” all mean the same thing. If you lose the fee is dropped hence the term no win no fee, and if you win the responsible insurance company will pay all the legal costs.
We can also set up an “after the event insurance” policy also known as “AEI”. This will protect you in the unlikely event that you may have to issue court proceedings. Please note that 99% of our cases are settled out of court but if you do have to issue court proceedings there may be costs from the other party if they choose to defend the claim. All these costs will be covered by the after the event insurance or AEI. Again put simply this means that you are fully protected against all costs win or lose so you will not have to pay a penny and get to keep 100% of your compensation.
Legal expense insurance or LEI
In some cases your own insurance company or Broker may have sold you legal insurance at a cost of £10 or so. If this is the case it does not affect the outcome of your case as you will still not be liable for any fees.
There has been much debate in recent years over the question of legal expense insurance. Some argue that you actually receive a poorer service as a result of buying this insurance. Sadly legal expense insurance is another way for insurance companies to make more money. This is because when they “recommend” a solicitor that is on their “panel” the insurance company receive a “referral fee” of up to £750 for passing your details to them. Usually this solicitor is not recommended but simply the highest bidder for your details! As a result you could be passed to anyone.
You have a choice which solicitor you can use. Many insurers do not like this as they miss out on their £750 referral fee if you do not use their solicitor that is paying for the case. If you do have legal cover and have chosen for us to deal with your personal injury claim we will request funding under the LEI policy from your insurer.
