			<content:encoded><![CDATA[<p>A bride from Ireland has received a payout for compensation for £42k after a ceiling fell on her wedding party whilst at the reception in, Setanta House Hotel in County Kildare, Ireland.</p>
<p>The wedding was ruined after the ceiling fell on the guests, it caved in just as the bride &amp; groom were about to take the floor for the first dance.</p>
<p> Joanne Noone, the bride, did attempt to flee the room with the groom &amp; some of the guests when they heard the loud cracks of the ceiling &amp; it began to give way. But Ms Noone was pinned to the floor by a heavy timber pillar after becoming trapped under ceiling debris. When Ms Noone attended the hospital she was advised that she had received soft tissue damage &amp; was complaining of pain to her neck, back &amp; legs. It was heard by the court that the bride had received mild post-traumatic stress from the ordeal of the wedding reception.</p>
<p> The groom, best man &amp; a number of the wedding guest have also filed for personal injury. They will make the claim against the hotel where the ceiling collapsed; they are due to be heard by the court. Luckily no one had any serious injuries as a result of this devastating accident.</p>
<p> Sadly for the newlyweds they had to cancel their honeymoon due to the horrible end to their wedding day. In court there was video evidence of the ceiling collapsing as was described by the judge as, “a pretty catastrophic event.” He also added that it was a blessing that no one was seriously injured as it could have been a lot worse, &amp; hoped the bride would get over this experience in time.</p>

			<content:encoded><![CDATA[<p>Brian Young, who is 54, was at work when he was sent out to deliver plastic bottles in a 15ft-high lorry in a gale force winds. He was sent out despite the fact that 8 similar vehicles were blown over in the same year. Brian was forced to give his job up as a lorry driver after he received permanent injuries from his former employment.</p>
<p> He was in the HGV heading north, when a gust of wind caught the vehicle &amp; blew it right over. This caused the vehicle to crash into a stone wall. Mr Young was then trapped under the lorry where he received a shattered shin &amp; ankle. He also suffered a number of cuts &amp; a fractured wrist, Mr Young is no longer able to work due to his injuries. After this he decided to make a claim for compensation against his employer, as the vehicle should not have been in use with the high winds as this caused a risk to the driver. His previous employer’s insurance company did dispute the liability, but they have now agreed to pay Mr Young £86,000, plus the costs to settle the case.</p>

			<content:encoded><![CDATA[<p>The mother of Cheshire teenager who has been left severely brain damaged by the MMR vaccine has won a compensation award of £90,000 from the government. Robert has many epileptic fits, is unable to stand unaided, talk or feed himself. Robert, now 18, from Warrington had suffered a fit just 10 days after receiving the injection when he was only 18 months old.</p>
<p> His mother Jackie has received a £90, 000 pay out from the medical assessment panel. The family appealed successfully after their application for compensation which was originally turned down in 1997. This was applied originally through the Government’s Vaccine Damage Payment Scheme.  Mrs Fletcher has always believed that her son’s epilepsy has been triggered by the combined measles, mumps &amp; rubella vaccine. The ruling &amp; compensation award was made up by a judge, a jury &amp; two doctors. It stated the ruling had no relevance to the question of a link between the vaccine &amp; autism.</p>
<p> The lead author of the controversial study, which was published in The Lancet in 1998 by Dr Andrew Wakefield, has suggested that there may be a link between autism, MMR &amp; Bowl disease. The comments made by him &amp; the media frenzy led to a sharp drop in the number of children that were vaccinated. Since then the study has been discredited &amp; The Lancet have said that they should not have run it.</p>
<p> Mrs Fletcher for the last 16 years has campaigned for her son’s justice. She said, &#8220;I feel vindicated by it because over the years I&#8217;ve been labelled anti-vaccine and a scaremonger and all sorts of things, when all I&#8217;ve been trying to do is highlight what&#8217;s happened to my son, to help safeguard other parents&#8217; children. What I&#8217;m hoping now is that other parents whose children have suffered a similar reaction to Robert can maybe go down the same route that we&#8217;ve gone down to achieve justice for their children”.</p>
<p> A spokesperson at the Department of Health said: &#8220;This decision reflects the opinion of a tribunal on the specific facts of the case and they were clear that it should not be seen as a precedent for any other case.</p>

			<content:encoded><![CDATA[<p>Tim Joplin, 58, a former artist &amp; lecturer has been left permanently<strong> </strong>paralysed in all four of his limbs. This is due to a delay in him receiving treatment at the hospital after a long seven year battle. Tim from Dudley has now won £825k; he was admitted to the Russell’s Hall Hospital in 2003 as he was complaining of neck &amp; shoulder pain.</p>
<p>The doctors there had originally thought that he had pulled a muscle, but Tim Joplin’s condition just got worse. He was eventually transferred to the Queen Elizabeth hospital located in Birmingham, where a scan exposed an abscess which was pressing on his spinal cord. The father of two had emergency surgery but the delay, caused by the hospital, made it too late.</p>
<p>Mr Joplin said: &#8220;The encounter I had at Russells Hall hospital in March 2003 changed me from being a socially skilled individual and useful member of my family to complete dependency and almost constant pain… no amount of financial compensation can buy me back my quality of life,&#8221;</p>
<p>Tim is now paralysed in all four of his limbs &amp; says that he is in ‘constant pain’. He has added that staff at Russell’s had repeatedly ignored his complaints &amp; from his family over his care. It was said by Tim, &#8220;Numerous polite enquiries were made to the staff expressing concerns about my care and pointing out my deterioration but none of these were addressed…I now want others to realise that they should not be complacent when seeking help from the NHS.&#8221;</p>
<p>Mr Joplin’s lawyer said: &#8220;Emergency surgery could have been performed earlier before the permanent neurological damage was caused thus avoiding Mr Joplin being tetraplegic.&#8221;</p>
<p>Since, Mr Joplin has received an apology letter from the chief executive of Dudley Group of Hospitals NHS Trust, Paula Clark. She accepts there were lessons to be learned from Tim’s case &amp; there are certain systems that do need to be rectified to ensure the protection of patient’s futures. She has also said, &#8220;There is now increased consultant cover in the accident and emergency department and clinicians have attended training in acute neurological emergencies.&#8221;</p>

<p>Lukasz Borowski received a life-long care package of £8.35 million after the road traffic accident left him wheel-chair bound.</p>
<p>Lukasz was a passenger in the Peugeot 307 travelling to work in Cambridgeshire when the car crashed into a ditch. He suffered damage to his spinal cord, a fractured spine and brain damage which left him with permanent loss of movement and sensation below his shoulders.</p>

			<content:encoded><![CDATA[<p>An actor from the channel 4 drama Shameless has been arrested after turning himself in at a police station in Central London. Mr Tittensor has been reported to be involved in an apparent hit-and-run incident.</p>
<p>He allegedly hit an 18 year old with his BMW Z4 in North London, Kentish town, on Sunday at 2am in the morning; Elliott Tittensor plays Carl Gallagher in the series Shameless.</p>
<p>The 18 year old was taken to hospital by an Ambulance as he was suffering from head injuries. He has been said to be in a serious condition but stable. Mr Tittensor went to the police station voluntary &amp; was given bail later that day.</p>
<p>A spokesman for the Metropolitan police said, &#8220;Police were called to reports of a collision involving a BMW Z4 and a pedestrian. An 18-year-old man was taken by London Ambulance Service to hospital suffering from head injuries.&#8221; He continued to say: &#8220;The male driver did not stop at the scene. He later handed himself into officers at a central London police station and was arrested in connection with the collision.&#8221;</p>

<p> He demanded this payout from GMB union who was his employer. He was a worker for a haulage company called P A Dunwell Transport Limited, based in Caistor.  His thumb was crushed whilst lowering the roof door of the lorry that he was unloading.  The door of the roof then came crashing down suddenly, trapping his thumb against the lever &amp; hitting his shoulder.</p>

			<content:encoded><![CDATA[<p>A Manchester family has won £35,000 in compensation after being struck down by carbon monoxide poisoning as a result of a faulty boiler.</p>
<p>The father called 999 after his four children, a family friend, and his wife were suddenly struck down with vomiting and other signs of poisoning. The family was given oxygen by the Paramedics and then taken to a specialist unit to have the poisonous gas removed from their bodies in a decompression chamber.</p>
<p>The carbon monoxide was found to be blamed when the father returned to the house after the incident with firefighters and noticed condensation around the boiler, which is a sign of carbon monoxide leakage.</p>
<p>British Gas had declared the boiler safe seven months before the leak, and claimed the leak was caused by freak weather conditions and thermal inversion.</p>
<p>The parents and children later accepted 60% responsibility for the leak but the family’s solicitor waited several years before settling the claim to make sure the victims had not suffered long-term health effects as a result of the poisoning.</p>
<p>After the children were found to be clear of long-term effects, the claim was settled and British Gas paid £35,000 in damages.</p>

			<content:encoded><![CDATA[<p><span style="font-family: 'Arial','sans-serif'; font-size: 10pt;">A dying asbestos victim has received an undisclosed sum of compensation from two major building suppliers. The settlement was reached out of court after the victim filed a lawsuit against the building material manufacturer after he was diagnosed with cancer.</span></p>
<p><span style="font-family: 'Arial','sans-serif'; font-size: 10pt;">At the beginning of this year, fifty two year old Garth Copp was told he had three months to live after he had been diagnosed with the asbestos related cancer. He claims that he was exposed to asbestos while working in Australia, in the 1970s and 1980s.</span></p>
<p><span style="font-family: 'Arial','sans-serif'; font-size: 10pt;">Copp claims that he breathed in huge amounts of asbestos while working, and would also get covered in asbestos fibers and dust. He claimed that the companies failed to “provide adequate warnings as to any risks of injury or illness” relating to their products.</span></p>
<p><span style="font-family: 'Arial','sans-serif'; font-size: 10pt;">A lawyer for the company said: “He is extremely relieved that the ordeal is over. Sadly Mr. Copp’s story is simply one of many in relation to the fight that victims of asbestos disease have”.</span></p>

			<content:encoded><![CDATA[<p>Caitlyn Ratcliffe has won 3,000 worth of compensation after a cupboard door trapped her fingers at the Wacky Warehouse during her Birthday party. She was taken to hospital as the storage cupboard door closed on her finger as she fractured her finger.</p>
<p>The little girl’s parents sued the Punch Taverns who own the pub tavern, as their daughter was unable to write anything at school &amp; became like a baby again due to this accident.</p>
<p>The parents Vicki and Alan Ratcliffe said that their daughter fractured her middle finger on her right hand. She has had it in a splint for 3 months after the accident in The Plough Inn, Alsager, Staffs.</p>
<p>On the 11<sup>th</sup> August 2010 the pub chain has agreed to pay out the compensation after the case was held at the Stoke-on-Trent County Court. This money will be put into a trust fund until Caitlyn’s 18 years old.  Her dad said &#8216;I&#8217;m glad the case is all over but we didn&#8217;t do this for the money.</p>
<p>&#8216;We just wanted the company to realise something had to be done. When Caitlyn came to me after the incident all I could see was blood. It was awful afterwards.She has a bunk bed and couldn&#8217;t climb the ladder so spent two months sleeping on a mattress at the side of our bed.&#8217; </p>
<p>Caitlyn was upstairs with her friends in a room above the Wacky Warehouse when the accident happened in February 2009. A member of staff had gone into the storage cupboard to get something, when she moved away from the cupboard it automatically shut &amp; that is when it was realised that her middle finger was then trapped in the door.</p>
<p>Caitlyn’s mother says &#8216;There was blood everywhere. Caitlyn was in a lot of pain, we were hysterical and her friends were too.&#8217;The door crushed the bone in her finger and she got an infection in the nail almost straight away. ‘She struggled with her finger for a year before it got better.&#8217; </p>
<p>Caitlyn is a right hander so this affected her at school she attends Bursley County Primary School. Caitlyn said the door shut by itself. It really hurt when it shut on my finger and I was upset. And when I was at school, I couldn&#8217;t write.&#8217; ‘&#8217;I want to buy a house or a car with my money.&#8217; </p>
<p>A spokesman for Punch Taverns said ‘a full internal investigation was completed and we are pleased a resolution has been reached.&#8217;</p>
