Can I get the registration number I need from the police?

If you are involved in an accident and the police get involved in the incident, this may be because a criminal act, such as hit and run may have occurred.  If a registration number was taken, you can claim for personal injury and vehicle damages, if needed.  The third party registration number, or the ‘at fault’ registration number is the key information that you will need in order to claim.  The police keep this information on record and all witness details if there were any.  Due to data protection, there are fairly strenuous rules and regulations you may have to go through in order to get the details back later on down the line.  We always recommend that if you are in an accident, always try your best to keep records for yourself at home, as this does save lots of time and hassle.  We cannot always get the information from the police on your behalf although we do try our best.  Often the communication will have to be done in writing and you may have to receive the information in a letter posted to your home address.  It is worth persevering.  It may seem time consuming, but you are entitled to the information from the police, so you will get it, but they may make you jump through a few hoops first!  In the long run, you will get significant compensation, so it is worthwhile.

Claim against a three-year-old child is a success.

Recently the claim against a three-year old child became a success and the victim was awarded compensation from the CICA, the Criminal Injury Compensation Authority.  The incident occurred in the back of a stationary vehicle where the two children had been left.  The three-year old child repeatedly struck the victim over the face and head with a car jack, leaving the child victim semi unconscious with excessive bleeding.  The car jack was used in such force that it managed to crack the car windscreen.  Originally it was ruled that the three-year-old attacker was too young to purposely injure another child and that there was no criminal intent.  However, after perseverance and patience the case finally became a success and compensation was awarded a second time round.  The attacker has since been taken into care and is being closely monitored by the social services.  This case has set a precedent, and will inevitably attract more similar cases to come to light.

Some insurers do have a department and an option to claim direct to them for personal injury claims.  This means that if you are involved in an accident and the ‘at fault’ driver was insured with Zurich for example, you can claim against them directly, instead of having legal representation for your personal injury.  In our opinion, this is not a good idea and only leaves you will hassle, stress, less compensation than you are owed and potentially a completely biased service.  When you claim directly, the insurer will ultimately try and save money by offering you far less compensation than you are actually entitled too.  Also, when you claim for personal injury often you have to see a medical expert that documents the injuries.  When you claim directly the insurer will appoint the medical expert.  This means that chances are, the expert will be biased towards the insurer and not have your best interests in mind.  Insurers will always attempt to pay out as little as possible, and without legal representation you don’t really have a leg to stand on.  Insurers will always recommend claiming through them directly so they can pay you less, and so they will not have to pay the legal fees.  When you claim through us at Complete Claim Solutions we are not biased and will always work to get you the maximum compensation as quickly as possible.  We do not charge any fees, ever, so you really have everything to lose and nothing to gain by claiming direct to an insurer, as opposed to us at Complete Claim Solutions.

I had an accident a year ago and it went 50/50 with my insurers so can I claim?

Yes you can.  Sometimes when you are involved in an accident liability can be split.  A 50/50 split is common or sometimes a 75/25 can be agreed.  This means that both parties involved in the accident are partly to blame for the incident.  If the case was settled 50/50, that obviously means that both parties were equally at fault.  Both parties are entitled to claim for personal injury in a 50/50 split and putting in a claim would not affect either person’s insurance premium.  What happens is the personal injury claim goes through as normal, but if your injuries are worth £3500 in compensation, you would receive half of that, so 50% which is £1750.  On a 75/25 split, if you get 75 you would be entitled to 75% of the compensation value, for example, if the compensation values £2000, you would receive £1500.  If you had 25, you would be entitled to 25% of your compensation and so on.  This is decided by the insurers not Complete Claim Solutions.  We still do not charge any fees whatsoever and do not take any deductions for your compensation.  It is always worth calling us for advice and we can explain further.

I was in a taxi when it crashed how do I claim?

My personal injury claim was settled for £300 can I get more?

Some insurers approach clients directly after an accident and attempt to settle a claim for personal injury, without the client seeking legal advice and going to a company such as Complete Claim Solutions.  The reason for this is simple; the insurers are trying to save themselves money.  Often they will settle your claim for far less value than it is worth, such as in this case, £300 for a whiplash injury is extremely low.  Some insurers even send out a representative to your door, which is often a salesman to put pressure on you to sign a declaration of ‘no injury’ or accept a low offer.  If this happens to you, don’t sign anything, but call us.
