The ‘no-win, no-fee’ agreement you will be asked to sign should you make a claim for personal injury is technically referred to as a ‘Conditional Fee Agreement’ or ‘CFA’ i.e. the fee is conditional upon a successful claim.

You will not have to pay a penny for your claim and this is why:

When you win your case (i.e. the other side admit fault and pay you compensation), the other side is under an obligation to pay all charges, disbursements, and success fee on top of your compensation, no exceptions.  Therefore in every case instead of us sending the bill to you, we send it directly to the ‘at fault’ insurer and deal with them directly in this matter.  You will receive your compensation in full: 100% without any deduction.  Under the terms of the agreement we are not allowed to make any deductions from the compensation you receive.

We have a success rate of over 99% however in the event that your claim is unsuccessful you are not in any way responsible for our charges. If we believe there is going to be a risk of you paying the other side’s charges, we will take out an insurance policy to protect you against this (ATE). The cost of the insurance policy is deferred until settlement of the case and is only payable if you are successful. Once again, it is payable by the ‘at fault’ insurers. You do not have to pay for the policy if one is taken out.

This means that we will under no circumstances be asking you to pay anything at any time. If you are successful, you will receive your compensation in full. If you are unsuccessful, you will not be asked to pay anything. This is our guarantee to you.

By signing the ‘no win no fee agreement’ you give us authority to claim back our costs from the ‘at fault’ insurer.  That is how we get paid; we do not get our money from you.  The ‘no win no fee agreement’ is a complex document, sometimes seeming contradictory, but this is essentially what it means.
